Terms of Service
These Terms are the agreement between you and The Adpharm for your use of Stock Photo MCP. Please read them — by using the service you agree to them.
The agreement
By accessing or using Stock Photo MCP — the website at www.stockphotomcp.com, the documentation, the account dashboard, and the MCP server at api.stockphotomcp.com (together, the “Service”) — you agree to these Terms and to our Privacy Policy. If you are using the Service for an organization, you confirm you have authority to bind it, and “you” means both you and that organization. If you don't agree, don't use the Service.
What the Service is
Stock Photo MCP is a Model Context Protocol (MCP) server that lets an AI agent search commercial stock-photo libraries live, return watermarked previews for review, and attach a purchase link to each result. It is a search-and-referral tool. We do not sell, license, host, deliver, or store the images themselves, and we are not a party to any license or purchase you make. Every purchase is completed on the vendor's own website, under the vendor's terms and pricing.
Eligibility
You must be the age of majority in your jurisdiction and able to enter a binding contract to use the Service. The Service is intended for business and professional use.
Accounts and API keys
- Sign-in is through Google; you're responsible for keeping your Google account secure.
- API keys authenticate your MCP client to the Service. Treat them like passwords: keep them secret, don't share them, and revoke a key you believe is exposed. We show a key's full value only once, at creation.
- You are responsible for all activity that occurs under your account and keys.
- We may suspend or revoke keys or accounts we reasonably believe are compromised, abused, or used in breach of these Terms.
Acceptable use
You agree not to:
- remove, obscure, or alter the watermark or the attribution attached to any preview or result;
- use previews as if they were licensed — previews are watermarked comps for evaluation only, never for publication or production;
- use the Service, or content retrieved through it, to train or fine-tune machine-learning models, or for any other use the source vendor prohibits;
- scrape, index, cache, or store results beyond what the Service and the relevant vendor's terms permit;
- circumvent rate limits, access controls, or authentication, or place an unreasonable load on the Service;
- resell, sublicense, or redistribute access to the Service; or
- use the Service in violation of any law, or of any stock-photo vendor's or affiliate network's terms.
Images, licensing, and vendor terms
The images you find through the Service belong to the vendors and their contributors, not to us. Previews are watermarked and unlicensed. To use an image you must license it through the purchase link, on the vendor's site, and comply with that vendor's license — including any required attribution, which the Service surfaces with each result. Your license is a contract between you and the vendor; we are not a party to it and make no promises about the images, their availability, or your right to use them.
Affiliate links
The purchase links attached to results are tracked affiliate links. Adpharm earns a commission when a user licenses an image through the tracked affiliate link attached to a result. The price is set and charged by the vendor, not by Stock Photo MCP. Using the links is optional and costs you nothing extra.
The Service is provided free and “as is”
The Service is currently provided free of charge. We may change, limit, suspend, or discontinue any part of it at any time, and we don't guarantee it will be available, uninterrupted, or error-free. The Service and all results are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that search results will be accurate, complete, suitable, or free of third-party rights issues; you are responsible for reviewing and properly licensing any image before you use it.
Our intellectual property
The Service's software, website, documentation, and the Stock Photo MCP name and branding are owned by The Adpharm or its licensors. These Terms grant you no right to them except to use the Service as intended.
Third-party services
The Service connects you to third parties — the AI client you use, the stock-photo vendors, and the affiliate networks. We don't control them and aren't responsible for their content, terms, availability, or practices. Your use of them is governed by their agreements, not ours.
Limitation of liability
To the fullest extent permitted by law, The Adpharm and the people acting for it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred Canadian dollars (CA$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless The Adpharm from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your use of any image, or your breach of a vendor's or other third party's terms.
Termination
You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive — including licensing, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
Changes to these Terms
We may update these Terms as the Service evolves. We'll change the effective date and, for material changes, take reasonable steps to notify you. Continuing to use the Service after a change means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree that the courts of the Province of Ontario, Canada have exclusive jurisdiction over any dispute arising from them, and you consent to that jurisdiction and venue.
General
These Terms, together with the Privacy Policy, are the entire agreement between you and The Adpharm about the Service. If any provision is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not assign these Terms; we may assign them to a successor or affiliate.
